Juvenile Lawyer Minneapolis, Minnesota Juvenile Defense Attorney
In Minnesota, the juvenile court system is vastly different than the adult court system, and it has its own unique set of rules and procedures. For example, juveniles are not entitled to a jury trial, but rather have their case tried before a judge.
The criminal justice system has long purported to recognize the difference between the “delinquency” of children and the “criminality” of adult offenders. The United States Supreme Court has chimed in, noting that “the State has a ‘parens patriae interest in preserving and promoting the welfare of the child’ [making] a juvenile proceeding fundamentally different from an adult criminal trial.” Schall vs. Martin, 467 U.S. 253, 263 (1984).
Most offenses committed by a juvenile offender fall under the jurisdiction of the juvenile court system. A juvenile, if found delinquent by the court, will be sentenced as a juvenile. However, if a juvenile is charged with a particularly serious offense, the State may seek to have the juvenile treated as an adult and be subject to adult penalties if convicted.
Penalties
Assuming the juvenile will not be treated as an adult, possible penalties for juvenile offenses include, but are not limited to: out-of home placement in a detention facility for a period of time, cognitive behavioral training, restitution, fines, probation, and periodic review by probation of the juvenile’s school records to be sure the juvenile is maintaining their grades.
